These Terms of Service ("Terms") govern your use of CarSmarti's vehicle anti-theft and recovery services ("Services"), offered by CarSmarti ("Company," "we," "us," or "our"), located at 2901 Clint Moore Rd. STE 2 #1049, Boca Raton, FL 33496. By activating, purchasing, or using any CarSmarti service or product, you agree to be bound by these Terms.
CarSmarti provides vehicle anti-theft and recovery services including but not limited to: License Plate Recognition (LPR) database access, paint-etching identifying decals, window warning labels, GPS recovery chip devices, steering wheel lock sets, Faraday key shield boxes, and 24/7 concierge recovery support. The specific services you receive depend on the plan you select at time of activation.
Upon activation, your vehicle will be enrolled in the National Recovery Network managed in partnership with Public Safety Crime Center (PSCC). You are responsible for providing accurate vehicle information at time of enrollment. CarSmarti is not responsible for recovery failures resulting from inaccurate information provided by the customer.
A recurring monthly service fee of $19.99 per enrolled vehicle begins 30 days after activation. This fee maintains your access to LPR database scanning, recovery advocacy services, and ongoing network enrollment. Fees are billed automatically to your payment method on file. You may cancel at any time to stop future charges — see our Cancellation Policy for full details.
Recovery services are activated only upon filing an active police report for a stolen vehicle. CarSmarti's recovery advocates work collaboratively with law enforcement but cannot guarantee vehicle recovery. Recovery outcomes depend on factors including law enforcement response, vehicle location, and condition at time of theft. CarSmarti makes no guarantee of recovery.
Physical products (GPS devices, steering wheel locks, key shield boxes, decals) are shipped to the address provided at activation. Products are subject to manufacturer warranty terms. GPS devices are replaced annually on active Premium plan subscriptions. It is the customer's responsibility to install or apply products as directed.
To the fullest extent permitted by applicable law, CarSmarti shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of vehicle, property damage, or financial loss resulting from vehicle theft, regardless of whether CarSmarti has been advised of the possibility of such damages. CarSmarti's total liability shall not exceed the total amount paid by you in the 12 months preceding the claim.
You agree to indemnify and hold harmless CarSmarti and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Services or your violation of these Terms.
Your use of CarSmarti's services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our Services, you consent to our collection and use of data as described in the Privacy Policy.
CarSmarti reserves the right to modify these Terms at any time. Changes will be posted on this page with an updated effective date. Continued use of the Services after modifications constitutes your acceptance of the updated Terms.
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts of Palm Beach County, Florida.
